Terms of Service

Last updated: September 2026.

1. Scope and contracting party

These Terms of Service govern the use of PerfDelta (the "Service"), a page speed and Core Web Vitals testing tool available at perfdelta.com. The contracting party for the Service is Christian Schreiber, Sybelstr. 42, 10629 Berlin, Germany (see Legal Notice). These Terms apply to the free plan available without an account and to the paid Solo, Agency and Scale plans described on the pricing page.

The paid plans are offered to businesses only — entrepreneurs within the meaning of section 14 of the German Civil Code (BGB), legal persons under public law, and public-law special funds. Paid plans are not offered to consumers within the meaning of section 13 BGB. Before checkout you confirm that you are ordering as a business; that confirmation is stored with a timestamp. The free test is unaffected and open to everyone.

2. Description of the Service

PerfDelta runs automated page speed tests against publicly reachable websites using the Google PageSpeed Insights API and the Chrome UX Report, and can generate AI-assisted optimization notes from the measured data. Test results ("reports") are stored under a shareable link for a limited retention period stated on the site. Anyone can run a free test without registering. A user account and a paid plan add features such as saved projects, monitored URLs with alert emails, longer report history, and API access, as described on the pricing page. The exact scope, limits and prices of each plan are those published on the pricing page at the time of purchase; this document does not repeat them.

PerfDelta is provided on a best-effort basis. Measurement results originate from third-party Google services, can vary between runs, and are not a warranted or certified measurement of any website's actual performance.

3. Registration and conclusion of contract

A paid plan requires a user account, created with an email address and password or via Google sign-in. You must provide accurate information and keep your login credentials confidential; you are responsible for all activity under your account. Before checkout you expressly confirm that you are ordering as a business within the meaning of section 14 BGB; without that confirmation the checkout does not open. The contract for a paid plan is concluded when you complete the checkout flow described in Section 4 and your payment is confirmed. PerfDelta may refuse or terminate accounts used for the demo domain, for automated abuse, or in breach of Section 7.

4. Prices, billing and payment processing via Paddle

Prices shown on the pricing page are net prices and exclude VAT or comparable tax. The applicable rate is determined by the country of your billing address; it is shown during checkout and added to the net price. Business customers in other EU member states with a valid VAT identification number are billed without German VAT under the reverse charge procedure. Plans are billed monthly or annually as selected at checkout. Checkout, invoicing, tax handling and payment collection for paid plans are carried out by Paddle.com Market Ltd ("Paddle") acting as our reseller and merchant of record. When you subscribe, you enter into a purchase agreement with Paddle for the payment transaction, while PerfDelta remains the provider of the Service itself. Paddle's own terms and refund conditions, shown to you during checkout, apply to the payment transaction. Invoices and receipts are issued by Paddle.

Paid subscriptions renew automatically for the same billing period until cancelled. Payment is due in advance for each billing period. If a renewal payment fails and is not resolved within a reasonable grace period, PerfDelta may suspend or downgrade the account to the free plan.

5. Term and cancellation

The free plan can be used and discontinued at any time; no notice period applies. Paid subscriptions run for the billing period selected at checkout and renew automatically unless cancelled before the end of the current period. You can cancel at any time through the customer portal linked from your dashboard ("Manage billing"), operated by Paddle. Cancellation takes effect at the end of the current billing period. Refunds, including for the current billing period, are handled by Paddle under the Paddle Refund Policy and can be requested as described in our Refund Policy. PerfDelta may terminate a paid subscription for cause, in particular for a material breach of Section 7 that is not remedied after a warning.

6. No right of withdrawal

The statutory right of withdrawal for distance contracts under section 312g in conjunction with section 13 BGB applies to consumers only. Because the paid plans are offered to businesses exclusively (see Section 1), and you confirm before checkout that you are ordering as a business, no right of withdrawal applies.

Independently of this, you can cancel an active subscription at any time with effect from the end of the current billing period (see Section 5). Refunds are governed by our Refund Policy, which applies the Paddle Refund Policy.

7. Acceptable use

You agree to use the Service only for websites you are authorized to test, and not to circumvent the rate limits, concurrency limits or API usage limits described on the pricing page or enforced technically. API keys and account credentials are personal to your account and must not be shared, sold, or used to resell access to the Service. You must not use the Service to test websites for the purpose of overloading them, or in any way that violates applicable law or infringes the rights of third parties. PerfDelta may suspend access without prior notice if there are reasonable grounds to believe the Service is being abused, and will inform you promptly once safe to do so.

8. Availability

PerfDelta is hosted on shared infrastructure and aims for reasonable availability, but does not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages (in particular of the Google APIs the Service depends on), or force majeure may cause temporary unavailability. No specific uptime is warranted.

9. Liability

PerfDelta is liable without limitation for damages caused intentionally or through gross negligence, for injury to life, body or health, and under the German Product Liability Act. For damages caused by ordinary negligence, PerfDelta is liable only for the breach of a material contractual obligation (an obligation whose fulfillment is essential to the proper performance of the contract and on which you may regularly rely), and in that case liability is limited to the damage typically foreseeable at the time the contract was concluded. Liability for indirect damages, lost profits, or damages resulting from the accuracy of third-party measurement data (Google PageSpeed Insights, Chrome UX Report) or AI-generated recommendations is excluded to the extent permitted by law.

10. Intellectual property

PerfDelta, its software, design and content (excluding the websites and data you submit for testing) remain the property of the contracting party named in Section 1. You may share and reference your own report links freely. You retain no rights to reports generated for domains you do not control, other than the shareable link itself.

11. Data protection

The processing of personal data in connection with the Service, including data processed by Paddle for billing, is described in the Privacy Policy.

12. Changes to these Terms

PerfDelta may update these Terms to reflect changes to the Service, legal requirements, or business practice. For active paid subscriptions, material changes will be announced by email or in-app notice at least fourteen days before they take effect; continued use of a paid plan after that date constitutes acceptance, and you retain the right to cancel under Section 5 if you do not agree.

13. Final provisions

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence. If you are a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction for all disputes arising from these Terms is Berlin, Germany. Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
